The Classifications of Rulings in the Hanafi Madhab

All praise and gratitude are due to Allah SWT. May the blessings and peace of Allah SWT be upon His Messenger PBUH.

Ahkam, or rulings, in the Shariah are derived from applying the methodologies of fiqh, or Islamic jurisprudence. There are different types of rulings, based on the evidence upon which the ruling is built.

A Hukm (ruling) Shar’i or a Sharia ruling is established via ‘a communication from the Law Giver (Allah, through His Messenger)’ (Taftzani: At-Talweeh, p.40). There are two aspects to the Hukm Shar’i. When communication is made from Allah or His Prophet SAW in the form of a demand (whether this be a demand to compulsorily or optionally do something or to compulsorily or optionally refrain from something) the Hukm is called ‘Al-Hukm Al-Taklifi’ (defining law or primary law).

The categories of al-Hukm al-Taklifi are outlined below. If the communication is made concerning a condition, a cause, or an impediment that is related to a primary demand, it is called al-Hukm al Wad’i (law of provision).

For instance, take the verse of the Quran – ‘establish regular prayers at the sun’s decline’ (Quran: 17:78). The legal ‘cause’ of the Dhuhr prayer, as communicated by Allah in this case, is the ‘sun’s decline’. An example of a conditional case of Al-Hukm Al-Wad’i would be the requirement of wudu before establishing prayer.

Furthermore, an example of a legal impediment would be physical or financial factors that impede upon one’s ability to carry out the hajj pilgrimage (Quran 3:97).

The commandments of the five pillars of Islam and the rights and obligations we are owed and owe as Muslims all fall within certain categories of Al-Hukm Al-Taklifi (defining laws). These categories have counterparts with respect to prohibiting laws.

For example, the prohibition of murder, adultery, drinking, theft and many more are also covered by the category of Al-Hukm Al-Taklifi. The implementation of these laws is the sole justification of the categories’ formulation.

All laws that provide the option of choice between two alternatives, possess the nature of ‘Takhyeer.’ This designation is self-evident, as man has the freedom and authority to commit them or avoid them. All rulings that are deemed ‘Mubaah’ (permissible, see below) fall within this category. 

The most important point, for our matter, is that the Defining or Primary Law is divided (according to the Hanafi School of Islamic Jurisprudence) into 11 grades, based on the strength of demand, textual proof and the scale of value contained in the demand. Here is a table that shows the grades from top (strongest demand with great proof) to bottom (weaker demands):

Each classification and its parallel possesses the same strength of demand but in a differing direction (eg. Haraam is parallel to Fardh as they both hold the same legal strength but Haraam is a grade of omission while Fardh is a grade of commission). 

Mubaah is optional and belongs to both – it may be committed or omitted, and there are no legal consequences for either committing or omitting a Mubaah act.

If there is a binding demand from the Lawgiver to do something and it is definitive (Qat’i) in text and meanings, it will give the legal value of Fardh. If it is a binding demand to abandon something with the same level of proof as Fardh, it will be Haraam.

Haram is also further divided into two:

      1. Haram li-dhatih, that which is forbidden for its own sake (such as wine, gambling) and,

      1. Haram li-ghayrih, that which is forbidden for an external reason (such as marrying a woman only to make her legal for another man, known as tahlil).

    Fardh and Haraam are two extreme grades of commission and omission proven from definitive communication (Qati’ al-Thabut & Qati’ al Dalalah) from the Law Giver. All other grades established from divine communication are lesser than definitive status.

    How to receive Ramadan?

    All praise is due to Allah, Lord of all the Worlds. May the peace and blessings of Allah be upon the Prophet, his household and companions.
    Allah has selected from the calendar seasons for righteous deeds. He selected some days, nights and hours out of His favour and kindness. Each time the moon of Ramadan is sighted, days of blessings and its fragrance return to Muslims, for Ramadan is a month in which fasting Muslims live in the horizons of purity and wipe off their foreheads the toils of this life.
    Ramadan is received while it fills the minds of righteous men in light and happiness. It is a source of joy for devoted worshippers. An hour of acceptance that a man attains in that month may elevate him to the pleasure of Allah. Fasting is a secret act of worship between the person and their Creator, which they observe sincerely the abstention of food and lawful lusts.
    In a Hadith Qudsy, the Messenger of Allah narrated that Allah says, “Every act of man is for him except fast. For it is for me and I am going to reward him for it.” In fasting, man learns the lesson of sincerity of purpose by which he can perform other acts of worship, far from hypocrisy and showing off.
    The fast reforms the heart, encourages commendable deeds and prevents corrupt deeds. It removes sins and increases reward. The Prophet said, “Whoever fasts in the month of Ramadan with faith and hoping to be rewarded by Allah, all his past sins will be forgiven him.” (Al-Bukhari and Muslim)
    The month of Ramadan is that of righteousness, acts of worship, kindness, forgiveness and mercy. The Prophet said, “When Ramadan comes, gates of the heaven are opened, gates of Hell are closed and devils are chained down.” (Al-Bukhari and Muslim)

    The Nights of Ramadan are blessed ones. In Ramadan,
    is a night which is the mother of all nights; it is Lailatul-Qadr; is better than 1000 months. Whosoever wakes up and prays on that night faithfully and hoping for the reward of Allah, all his past sins will be forgiven for him.
    It is a month in which the Muslim patiently bears the pains of hunger and thirst and in which he denied his soul of its desires. The reward of the fasting Muslims would be entrance into Paradise through a gate that none except them will be allowed to enter. Fasting reminds one of the conditions of the poor and destitute who suffer the pain of hunger throughout the year. Fasting removes the gap that is between the poor and the rich, for all is fasting, seeking the forgiveness of his Lord, abstaining from eating and drinking and breaking the fasting at the same time. They are equal in all these so that the word of Allah, “And I am your Lord, so fear Me.”, may be actualised.
    The Glorious Quran, the foundation of Islam, the symbol of Prophetic Message, and the soul of human life was revealed in the greatest of all months, the month of Ramadan. Allah says, “Indeed, We have revealed it (the Quran) in the Night of Decree.”
    There is in its revelation in this month a covert directive for Muslims to recite it and reflect over it and recite it in that month. The Angel Jibreel used to descend from the heaven in that month and would study the whole of the Quran with the Prophet. And in the year in which he died, Jibreel studied the Quran with him twice.
    Some righteous predecessors would completely recite the Quran every three nights, some would recite it completely every seven days and some every ten days. Imam Malik would devote himself to the recitation of the Quran and leave Hadith aside, whenever Ramadan entered.
    Let your sayings and deeds be righteous. Believing hearts’ love for voluntary good deeds increases the scope of generosity. Generosity and charity do not impoverish. It is rather a good loan that is guaranteed with Allah. Allah says, “And whatsoever you spend of anything (in Allah’s Cause), He will replace it. And He is the Best of Providers.” (Saba’ 34:39)
    Allah multiplies the reward of good deeds in this world and rewards it with Paradise in the Hereafter. The Prophet said, “There is not a single day in the life of man except that two angels descend on the earth. One of them says, ‘O Allah! Give replacement for the one who spends’ and the other says, ‘O Allah! Destroy the wealth of the stingy.'” (Al-Bukhari and Muslim)
    Look for the homes of the poor, the destitute, the widows and orphans. For that will remove sorrow from you and avert affliction from you. The Messenger of Allah was the most generous of all people. He used to give generously and abundantly and he would give like the one who never fears poverty. He received Ramadan with generosity and would be more generous, giving like the wind. Try, therefore, to emulate the Prophet by being generous through the month of Ramadan. For wealth can never be retained by covetousness and stinginess, as it can never be removed by spending in the right cause.
    Ramadan nights is the crown of all nights. Its darkness is precious. Its hours are the purest and it is then that meditation is most enjoyable. The Prophet said, “The best prayer after obligatory ones is the night prayers. Whoever prays behind the Imam until he finishes, the reward of night prayer will be recorded for him.” Whoever does not subject his soul to patience over acts of worship and subjects it to the love of Allah, he will be afflicted by subjecting it to sins and their humiliation.
    Every night, the doors of acceptance of deeds are opened fro the heaven. Ask, then, Allah for His bounties and beseech him to have mercy on you, for this month is that of gifts and mercy. The weakest person is the one who cannot invoke Allah.
    Days are pages of life and the prosperous is the one who does best deeds. Whoever Allah removes from humiliation to the honour of obedience to Allah, he will enrich him without any money. Peace of mind lies in committing few sins. There are in this blessed month in which the Quran was revealed great opportunities to seek for Allah’s forgiveness, perform righteous deeds, making a lot of invocation and carrying out many acts of worship. However, there is a loser for every season. Some people use their Ramadan nights in watching TV programs, engaging in illusionary thinking and aspiring for imaginary happiness. And at the end of Ramadan, such people gain nothing world-wide and achieve nothing for their Hereafter.
    Women are snares of Satan and they are the greatest fuel of Hell. In order to save herself from Hell, she must multiply her good deeds and she should fear Allah in this blessed month ad not go out of her house except under pressing needs. It is better for her to observe her Taraweeh prayer at home, for doing so is better than to observe it in the two Sacred Mosques. The Prophet said, “Woman’s prayer at home is better for her than her prayer in the mosque.”
    When she however does go out, she should go out fully dressed without exposing anything of her beauty. She must remain modest and fear her Lord.
    Righteous women are promised the Pleasure of Allah. A woman’s adherence to her religion and her pride in her hijaab respect her and give her honour in the society. Such a righteous woman is a source of pride for her society, a crown of chastity, a jewel of life and a model for other women. Allah says, “O you who believe! Fasting is prescribed for you as it was prescribed for those who were before you that you may have piety.”
    Fellow Muslims! Remedy for heart diseases lies in five things: recitation of the Quran with reflection over its meaning, freedom of the stomach from excess food, performing prayers in the night, invoking Allah with humility in the dark of the night and keeping the company of righteous men.
    Let there be for you in Ramadan good deeds, night prayers and recitation of the Quran. Take an opportunity to perform ‘Umrah in Ramadan, for that is equivalent in reward to Hajj. It was part of the Prophets guidance to do I’tkaf in Ramadan; for that which is to stay in the mosque for the purpose of worship. It also means, to devote one’s heart to Allah alone, to shun the world and to preoccupy oneself with acts of worship and recitation of the Quran. Abstain from things that invalidate fasting. Keep away from attacking the honour of Muslims and guard your tongue, ears and eyes against forbidden things.
    Imam Ahmad said, “The fasting Muslim should protect his fasting from the evil of his tongue and he should not argue with people. When the righteous predecessors fast, they would remain in the mosque and would say, ‘We shall protect our fasting and shall not backbite anyone.’ Whoever is wronged by an ignorant person should not reward that with another wrong.” The Messenger of Allah said, “Fasting is a protection. On the day of your fasting, you should not say obscene thing nor should he rage; and if anyone should abuse or insult him he should say, ‘I am fasting.’ ” (Al-Bukhari)
    Let your month of fasting be that of continuous struggle against desire and of devotion for acts of worship and of study for verses of the Quran and sincere night prayers.
    Ramadan is a season for repentance. The gate of acceptance of repentance and that of infinite divine blessing are open in this month. When will the one who has committed excessive sins repent if he does not repent in the month of Ramadan? When will he return to Allah, if he does not return to Allah and ask for His Forgiveness?
    Keep away from competing with different kinds of food and drink. For seasons of good deeds deserve better and more useful deeds. Make use of your month in acts of worship and righteous deeds.
    Use the opportunity of these few blessed days in good deeds. Do not waste them with pastime, fun and useless things. For you do not know when you will be returned to Allah. You do not know whether you will live till next Ramadan or not. The wise person is the one who ponders over his condition, reflect over his faults and reforms himself before death suddenly but surely comes.
    May Allah SWT allow us all to benefit the most from the blessing of the Holy month of Ramadan and accept our all good deeds.. Ameen.

    Qadar: Divine Ordainment and Predetermination

    All praise and thanks are to Allah SWT. May the peace and blessings of Allah SWT be upon the Prophet Muhammad PBUH, his family, companions and followers.

    The concept of Qadar denotes that Allah SWT has decreed everything that happens in the universe according to His prior knowledge and the dictates of His wisdom. The word Qadar is linguistically defined as to measure, assess and determine, and has been used in the Qur’an frequently. More commonly, Qadar refers to the pre-measurement of things, or pre-destination. It is an obligation in Islam to have faith in Qadar. A person who claims to be a Muslim—one who submits to Allah’s will, guidance and order—but does not believe in Qadar, cannot truly submit to Allah SWT.

    As stated in the Hadith of Jabir RA: “No slave of Allah will truly believe until he believes in Al-Qadar, its good and bad from Allah, until he knows that what has befallen him was not going to miss him and that what missed him was not going to befallen him.” [Tirmidhi]

    For example, at war, people may win a victory or lose despite having taken precautions. It can be said that it is the destiny, or Qadar, of war that one will either end up a martyr or a veteran. Heavy rain may lead to flooding in the lowest-lying areas, even if precautions have been taken, if that is the area’s Qadar. A violent earthquake may level many buildings, even if they were well-built. A professional swimmer may be drowned in the sea. If that is its Qadar, it will happen.

    Characteristics of Qadar

    Belief in Qadar consists of four things:

    1. Allah’s knowledge: the belief that Allah SWT knows all things in general and in detail, from eternity to eternity, whether that has to do with His actions or the actions of His slaves.

    Allah SWT knows what was, what is, what will be, what is not, and how it would have been if it were to be.

    “But do they not know that Allah knows what they conceal and what they declare?” [Qur’an 2:77]

    2. Allah’s will: the belief that whatever happens only happens by the will of Allah SWT—whether that has to do with His actions or the actions of created beings.

    We might sometimes want things and at the same time, Allah SWT wants something else; the result will be whatever Allah wants and He will do. A specific example is the birth of Prophet ‘Isa AS without a father.

    “…exalted is He! When He decrees an affair, He only says to it, “Be,” and it is.” [Qur’an 19:35]

    3. Allah’s creation: the belief that all things that happen are created by Allah SWT in their essence, their attributes, and their movements.

    Physical things (such as solid bodies, gases, liquids, light, darkness, etc.), emotions, intentions, thoughts (such as mental decisions, love, hate, positive and negative suspicions, imaan, kufr, etc.) and actions (such as moving your body parts, speaking, breathing, etc.) are all part of the creation of Allah SWT.

    “Indeed, all things We created with predestination.” [Qur’an 54:49]

    4. Allah’s recording of all things: the belief that Allah SWT has written all happenings in Al-Lawh Al-Mahfoodh (the Book of Decrees).

    The past, present and future of the universe—of the things to exist (who will be born, the earth’s population, what will be created, etc.); of what will happen each year; and of what will happen each day—is recorded by Allah SWT.

    “And there is no creature on earth but that upon Allah is its provision, and He knows its place of dwelling and place of storage. All is in a clear register [Al-Lawh al-Mahfoodh].” [Qur’an 11:6]

    Changing Qadar

    Du’aa is the weapon of the believer and the only thing that can change one’s Qadar. Allah SWT says, “And your Lord says, ‘Call upon Me; I will respond to you.’ Indeed, those who disdain My worship will enter Hell [rendered] contemptible.” [Qur’an 40:60]

    In another verse, Allah SWT says, “And when My servants ask you, [O Muḥammad], concerning Me – indeed I am near. I respond to the invocation of the supplicant when he calls upon Me.” [Qur’an 2:186]

    It is important to note, however, that du’aa is beneficial with regard to what has been decreed and what has not been decreed.

    The Prophet Muhammad PBUH said, Nothing can change the Divine decree except du’aa.” [Ahmad, Ibn Maajah, Tirmidhi]

    It was narrated from Ibn ‘Umar RA that the Prophet PBUH said, “Du’aa may be of benefit with regard to what has already happened or what has not yet happened, so adhere to du’aa, O slaves of Allah.” [Tirmidhi]

    If a person chooses not to make du’aa because he relies on the divine decree, he is mistaken as Allah SWT has made du’aa as a means of attaining His forgiveness, mercy, guidance, support and provision. If good is decreed for a person, he will attain by means of du’aa what he cannot attain without it.

    The Prophet PBUH said, “No precaution can protect against the decree of Allah. Du’aa is beneficial with regard to what has been decreed and what has not been decreed. The du’aa meets the calamity that has been decreed and wrestles with it, until the Day of Resurrection.” [Tabaraani, Al-Albaani]

    Du’aa is one of the most beneficial of remedies. It is the enemy of calamity; it wards it off, remedies it, prevents it befalling, alleviates it or reduces it if it befalls. In the case of a calamity, one of three scenarios will apply:

    1. If the du’aa is stronger than the calamity, it wards it off.
    2. If the du’aa is weaker than the calamity, the calamity overpowers it and befalls the person, but it may reduce it even if it is weak.
    3. Du’aa and the calamity resist one another and each impedes the other.

    Du’aa is one of the means by which what is asked for is attained. It is the only thing that wards off the divine decree. For example, a person may pray to Allah SWT to achieve a certain thing and he achieves it with the help of his du’aa. From this, we can understand that Allah SWT decreed that the person would attain the achievement by means of his du’aa, which was also decreed. The person may think that were it not for his du’aa, he would have been deprived of it—but in fact, he did not ward off his Qadar. The basic principle is that making du’aa was decreed for the person to attain his achievement, and this is his original fate decreed from eternity.

    The same applies to everything that is decreed to happen through any means. Allah SWT has made this means the cause for something to happen, and that was written from eternity, well before it even happened.

    Qadariyyah and Jabariyyah

    Jabariyyah is a term that refers to a group of early Muslim scholars who claim that Allah SWT has given man no freedom of choice whatsoever. Jabariyyah is of the opinion that we, as Allah’s slaves, are deprived of all will, choice and ability.

    On the other hand, Qadariyyah is used to refer to those people who assert that all deeds whether good or bad, come from man and not from Allah SWT. Qadariyyah makes the slave a rival to Allah SWT—meaning he does as he wants without the will of Allah and without His aid.

    The two concepts are thus polar opposites; one is too extreme, and the other is negligent and wasted. These two sects of Islam both suggest that Allah SWT has faults, which He does not have.

    A Muslim’s purpose

    What does the Creator tell us about our purpose in life? Allah SWT states in the Qur’an that He created man to be His Khalifah, His trustees on earth [Qur’an 2:30]. Mankind’s basic trust and responsibility is to believe in and worship Allah SWT. Allah says, “And I did not create the jinn and mankind except to worship Me.” [Qur’an 51:56]

    Allah SWT further states that He made this life to test man so that every person may be recompensed after death for what he has earned. “[He] who created death and life to test you [as to] which of you is best in deed – and He is the Exalted in Might, the Forgiving.” [Qur’an 67:2]

    Suffering in Islam

    Suffering in Islam should be seen as a test and trial given to us by Allah SWT in order to test our patience and steadfastness. Even Allah’s Prophets and Messengers were made to endure hardships. Prophet Ayyub AS, in particular, is mentioned in the Qur’an as a Prophet who was extraordinarily patient through the trials he faced. Good people are sometimes made to suffer, but their sufferings heal others and bring goodness to their communities. Martyrs die for their faith and soldiers give their lives for their nations to bring liberation and freedom for their people.

    At times, Allah SWT causes us to suffer to test us with how we react to our difficulties. When you deal with a person who is sick, poor or needy, your faith and charity are being tested by Allah. He SWT says, “Indeed, We created man from a sperm-drop mixture that We may try him; and We made him hearing and seeing. Indeed, We guided him to the way, be he grateful or be he ungrateful.” [Qur’an 76:2-3]

    Many religions teach its followers how to avoid suffering or how to combat it. Islam, on the other hand, teaches us to embrace it and love it for the fact that patience while suffering is Allah’s means for us to receive the highest of His rewards.

    Hardships are bestowed on us in order to teach us to adhere to Allah’s natural and moral laws. Sometimes it is to punish those who violate these laws, but mostly it is to test our faith in Allah SWT and our commitment to human values and charity. Whenever we encounter suffering, we should ask ourselves if our struggling could be a punishment. If so, we repent, ask forgiveness and make the intention to reform our ways. If not, we should accept that our difficulties are a test from Allah SWT and work hard to pass the trial.

    “Verily, We shall put you to test with some fear, and hunger, and with some loss of wealth, lives, and offspring, And (O Muhammad) convey good tidings to those who are patient, and to say, when inflicted by hardship, ‘Verily we are of God and verily to Him shall we return’; upon them is the blessings of Allah and His Mercy.” [Qur’an 2:155]

    There are innumerable miseries, accidents, floods, earthquakes, fires, robbery, war, riot, famine, epidemics – all such things have effect upon our lives, and Allah tells us in this ayah that we are being tested as how we react to them. Does our faith remain unshaken? If so, Allah SWT tells us that we will be rewarded for it.

    Free will in Islam

    We humans are automatically aware that we possess freedom in our actions; we can decide as we wish and fashion our own fate in accordance with our own will and inclinations. The existence that decrees responsibility for us, the regret we feel for certain acts we commit, the punishments the law provides for criminals, the deeds we accomplish in order to change the course of history, the foundation of science and technology—all of these prove mankind to be free in our actions. Likewise, the question of our religious accountability, the sending of the Prophets, the proclamation of divine messages, and the principle of resurrection and judgment—all these rest on our free will and the choice in the acts we perform.

    It would be completely meaningless if Allah SWT, on the one hand, was to compel us to do certain things and, on the other, reward or punish us. It would surely be unjust if the Creator of the world set us on whatever path He chose, by means of His power and His will, and then to punish us for actions we have committed without any choice on our part. If there were no free choice for mankind, the whole concept of religious accountability would be unjust. The oppressive tyrant would deserve no blame and those who are just would merit no praise, because responsibility would only have meaning within the sphere of what is possible and attainable for man. Humans deserve blame or praise when they are able to decide and act freely; otherwise, there can be no question of blame or praise.

    By having freewill, we can struggle against the temptations of this world. By turning to Allah SWT for help and surrendering to Him, we can overcome many of our weaknesses. In our own human societies, who do we admire more—the average person who has learned to walk, or someone who has learned to walk after overcoming a birth defect or accident? If we were never tempted, or never even had the possibility of being tempted because we did not have freewill, would we deserve as much reward as we do for overcoming temptations?

    In saying this, it is important to remember that we still only have the freedom to do as we like within the limitations Allah SWT has set for us. You are able to move your leg because Allah has given you the power to do so. However, you cannot control the muscles of your heart and lungs. We cannot change the features on our faces, for example, or alter our height. Such aspects of our life are pre-determined. Nevertheless, our free-will is not affected by the fact that certain aspects of our life have been pre-determined.

    How a person is held responsible for certain behaviours depends on how he exercises his free-will. Punishment and reward are therefore results of the course of action we choose to follow using our own free-will. We are held accountable for what we have consciously chosen to do—good things we do will stand in our favour and the mistakes we make will stand against us. Everyone will be judged according to the choices they make.

    Allah SWT says in the Qur’an, “The truth [has come] from your Sustainer: let, then, him who wills, believe in it, and let him who wills, reject it.” [Qur’an 18:29]

    In this ayah, Allah SWT explains that man is free from compulsion when he is not restrained or coerced by forces or persons outside of himself. He is free when he can follow his own desires and will. According to this ayah, as well as many others, man is born free to choose between alternatives, free to choose good from evil and free to act in accordance with his will. Allah SWT also says, “Would you compel people to believe?” [Qur’an 10:99], signifying that people are under no compulsion by Allah to believe or disbelieve and that they should not be compelled in this regard by other people.

    Allah SWT is the best of planners

    “And [remember, O Muhammad], when those who disbelieved plotted against you to restrain you or kill you or evict you [from Makkah]. But they plan, and Allah plans. And Allah is the best of planners.” [Qur’an 8:30]

    In this ayah, Allah SWT tells us that He is the best of planners. In this instance, Allah is relating to the time when the disbelievers wanted to kill Muhammed PBUH. Allah SWT explains that whatever difficulty He had put the Prophet PBUH through, He had a plan that would bring out the best.

    It is important to always remember to trust in Allah SWT’s Qadar as He always has a plan and He SWT is the best of planners. We humans often try to control every aspect of our lives, needing to set everything out in the way we think is best for us. Often when our plans don’t go accordingly, we tend to get frustrated and impatient. What we should do is to believe that Allah SWT had a different, better plan for us for He knows everything and we do not. In that moment, while we may feel disappointed and upset, we may have been spared of a terrible calamity that Allah had the foresight of and we did not.

    As a reminder to myself first, let us always place our trust in Allah SWT’s plan and in our Qadar, while exercising our free will as human beings to consciously make the right decisions to remain on the straight path.

    Indeed, Allah has the best of plans and He knows best.

    The First Ten Days of Dhul-Hijjah and the Day of ‘Arafah

    My dear brothers and sisters,

    These days, we are living the most loved days in Islam. Narrated by Ibn Majah, the Prophet Muhammad PBUH told us that there are no days in this life that are more beloved to Allah SWT in which He may be worshipped than the first ten days of Dhul-Hijjah, as well as fasting the day of ‘Arafah. Fasting this day is equal to fasting the entire year in terms of rewards and the night of Al-Qadr in Ramadan. These 10 days of Dhul-Hijjah are the first 10 days of the month in which the fifth pillar of Islam is performed, Hajj.

    The Prophet Muhammad PBUH has informed us that there are some days in the year that contain the best opportunities in which one can gain a great amount of good deeds. From these days are the 10 days of Dhul-Hijjah. It has been narrated by Al-Tabarani that the Prophet Muhammad PBUH has said that for Allah SWT, there are several days in the year that are great opportunities for the Muslim to gain rewards in, so always try and utilise these days in the case that you may eventually find an opportunity that would lead you to having a life of happiness and rewards throughout the rest of your life.

    Allah SWT has sworn by the first 10 days of Dhul-Hijjah in the Holy Qur’an and when Allah swears by a specific idea or concept, it indicates its status and importance to Him. This has occurred in other places in the Qur’an such as in Surah Al-Fajr where it says وَالْفَجْرِ وَلَيَالٍ عَشْر. Here, the word Al-fajr is self-explanatory and indicates the dawn, however, when the verse continues Walayalin ‘Ashr, this is believed by some scholars to indicate the 10 days of Dhul-Hijjah.

    It is also believed by some of the scholars that these 10 days of Dhul-Hijjah are the best days of the year as they not only contain the day of ‘Arafah, but also includes the greater Eid, Eid Al-Adha, as well as the fact that Allah SWT has sworn by these 10 days. This is further reinforced by the hadith narrated by Al-Bukhari where the Prophet PBUH said there are no better days in which you can worship Allah SWT and work in them than the first 10 days of Dhul-Hijjah. He was then asked, “Not even Jihad?”, to which he replied not even Jihad, except in the case that a man goes to Jihad while risking all his wealth and himself and does not return with anything.

    Another hadith, narrated by Abu Dawud, indicates to us that the Prophet Muhammad PBUH also said that a Muslim should be calm and collected when performing our daily tasks generally; however, when it relates to tasks such as worship and tasks related to our Akhirah, then rush in them. This is also shown in the Qur’an where Allah SWT says, [فَاسْتَبِقُوا الْخَيْرَاتِ] which means, “So let whoever aspires to this strive diligently.”

    It is recommended for us during the first 10 days of Dhul-Hijjah to fast Mondays and Thursdays and to fast the day of ‘Arafah, the day before the first day of Eid Al-Adha, and to spend as much as we can in Sadaqah as well as many other good deeds. It has been narrated by Ibn Hiban that the Prophet Muhammad PBUH said that there are no other days that are better than the day of ‘Arafah, on which Allah boasts to the people of Heaven all the good deeds that the people of the Earth were performing.

    The day of ‘Arafah is known to be the ninth day of Dhul-Hijjah, a day on which the Muslims performing Hajj would spend the day on the Wadi[as1] of ‘Arafah located in Mecca, performing one of the last rites of Hajj where they stand on ‘Arafah and make du’aa as well as pray shortened Dhuhr and ‘Asr prayers together. After this they would continue to make du’aa endlessly up until the setting of the sun.

    The Blessings of A'rafah and the First 10 days

    There are numerous ayat in the Qur’an and Ahadith that discuss the benefits of the day of ‘Arafah as well as the first 10 days of Dhul-Hijjah and the amazing bounties and rewards of those days. These benefits are listed as follows.

    1. The 10 days are the best days in the year, as already mentioned.

    2. The day of ‘Arafah was the day in which Islam had been completed as a religion, where Allah SWT says in the Quran:

    [الْيَوْمَ أَكْمَلْتُ لَكُمْ دِينَكُمْ وَأَتْمَمْتُ عَلَيْكُمْ نِعْمَتِي وَرَضِيتُ لَكُمُ الْإِسْلَامَ دِينًا]

    “Today I have perfected your faith for you, completed My favour upon you, and chosen Islam as your way.” [Quran 5:3]

    3. The day of ‘Arafah is the day of forgiveness and fasting; it removes the sins of two years, where in a hadith narrated by Al-Tirmidhi, it is stated that the Prophet PBUH said that should one fast the day of ‘Arafah, the deeds of the year before and the year to come will all be forgiven.

    4. The day of ‘Arafah is the day in which Allah SWT will free us as Muslims from the fire in the hereafter [Al-Nisai]

    There are also many good acts that would reward one with many good deeds that can be performed on this day such as:

    1. The fasting of ‘Arafah

    2. Supplication to Allah SWT being accepted on this day

    3. Calling to Allah SWT through use of the takbirat and to remember Him at all times

    4. The Eid al-Adha prayer, as well as the act of slaughtering a cow or sheep for the sake of Allah SWT as a sacrifice to Him in the form of a Qurban. Allah SWT says in Surah Al-Kawthar:

    [إِنَّا أَعْطَيْنَاكَ الْكَوْثَرَ – فَصَلِّ لِرَبِّكَ وَانْحَرْ – إِنَّ شَانِئَكَ هُوَ الْأَبْتَر]

    “Indeed, We have granted you, [O Muḥammad], al-Kawthar. So pray to your Lord and offer sacrifice [to Him alone]. Indeed, your enemy is the one cut off.” [Quran 108:1-3]

    Oh Allah, we seek refuge in You from being misguided, a misguider, oppressed, an oppressor, attacked or attacking someone. Amee

    Month of Ramadan 1442H and Sighting the Moon

    All praise and thanks are to Allah SWT, may the peace and blessings of Allah be upon the Prophet Muhammad SAW, his family, companions and followers.

    Assalamu Alaykum Wa Rahmatullahi Wa Barakatuh

    Very soon, we Muslims will be receiving a dear guest who visits us once a year. This guest always comes with goodness, both for this life and the hereafter.

    This guest is the month of Ramadan. The Prophet PBUH mentioned: “When Ramadan begins, the gates of Jannah are opened, the gates of Hell are closed, and the devils are chained” [Al-Bukhari and Muslim]

    This month brings joy and happiness to all the Muslims around the world and we become excited in meeting this holy month.

    On behalf of the team at Baseerah, we would like to take this opportunity to extend our sincere congratulations to all brothers and sisters in Australia, and the wider Muslim Ummah, for another opportunity to re-live this holy month, asking Allah SWT to let us reap the fruits and gain the benefits from it as blessings in this life and Hassanat in the hereafter. Ameen.

    In light of this occasion, I would like to take this opportunity to explain and emphasise a very important issue concerning all Muslims and capture their attention.

    This issue is:

    The Beginning and End of Ramadan

    This very important matter is already explained in the Hadith of the Prophet PBUH where he said: “Start fasting on seeing the crescent (of Ramadan), and give up fasting on seeing the crescent (of Shawwal), and if the sky is overcast (and you cannot see it), complete thirty days of Sha’ban.” [Al-Bukhari]

    Regarding this issue, I would like to share with you the scholars’ opinions about this matter, as mentioned in the book of Fiqh-us-Sunnah, authored by Sheikh Syed Sabiq.

    Under the title, Different Locations, the book quotes: “According to the majority of scholars, it does not matter if the new moon has been sighted in a different location. In other words, after the new moon is seen anywhere in the world, it becomes obligatory for all Muslims to begin fasting, as the Prophet said: ‘Fast due to its sighting and break the fast due to its sighting’.”

    This Hadith is a general address directed to the whole Muslim world – that is: “if any one of you sees the moon in any place, then that will be a sighting for all people of the world.”

    However, according to the correct opinion among the Hanafi and the chosen opinion among the Shaf’’i, every ‘country’ (or territory) is to take into consideration its own sighting and not necessarily follow the sighting of others. This is based on the well-known story of the Sahabi Kuraib, who relates:

    “While I was in ash-Sham, the new moon of Ramadan appeared on Thursday night. I returned to Madinah at the end of the month. There, Ibn ‘Abbas asked me: ‘When did you people see the new moon?’

    I said: ‘We saw it on Thursday night.’ He said: ‘Did you see it yourself?’

    I said: ‘Yes, the people saw it, and they and Mu’awiyah fasted.’ He said: ‘But we saw it on Friday night. We will not stop fasting until we complete thirty days or until we see the new moon.’

    I said: ‘Isn’t Mu’awiyah’s sighting and fasting sufficient for you?’ He said: ‘No… This is the order of the Messenger of Allah.’” [Ahmad and Imam Muslim]

    Scholars act in accordance with this Hadith. Every land has its sighting. It is stated: “The [opinion] closest [to the truth] is that each land follows its sighting, as well as the areas that are connected to it.”

    The Beginning and End of Ramadan in Australia

    Regarding this issue, Muslims in Australia are of three groups:

    1. The first group base it purely on the calculation of the birth of the new moon. This group follows the lunar calendar, regardless of the sighting of the moon. So, for them, the beginning and the end of Ramadan, as well as each Islamic month, can be known beforehand for maybe the next 10 years, or even longer, because they only follow the calculations.

    The disadvantage of this method is the reliance on the calculation only, while possibly disregarding the moon sighting. It also focuses on the moon birth rather than the actual sighting.

    2. The second group base it on actual sighting of the moon with their naked eye, regardless of the calculation method. So, for them, the month never starts or ends until the moon is sighted with the naked eye, regardless of any other methods.

    The disadvantage of this is they may not be able to sight the moon at the exact and correct time. In addition, particularly for Australia, the location and weather conditions do not always allow for clear moon sighting. As a result, this method may cause errors at the beginning and the end of the month.

    3. Amongst other international scholarly organisations, the Board of Imams Victoria follow the third opinion: the method of Imkaniyyatur-Ro’ayah, the “possibilities of moon sighting”.

    In this method, the Board of Imams try to combine the above two methods. They use calculations to know the time of the new moon birth, then they look at the sunset and the moonset, and then they calculate the time difference between the sunset and the moonset.

    So, on the 29th day of the month of Sha’ban, if the moonset is going to be after the sunset by enough time to allow the moon sighting (that is at least 10 minutes), they decide that this day is the last day of Sha’ban and the following day is the beginning of Ramadan. They do the same with each Islamic month. An example is shown in the following:

    The above table shows that the beginning of Ramadan this year is most likely expected to be on the 13th of April 2021, InshaAllah.

    The advantages of the method adopted by the Board of Imams are as follows:

    · It follows the sunnah of the Prophet PBUH by considering the moon sighting through the “possibility of moon sighting” (Imkaniyyatur-Ro’ayah).

    · Its use of the calculation method is based on advanced astronomical knowledge and technology.

    · It is a practical method which allows the Muslims in Australia to plan their business beforehand. Thousands of Muslims, who are working in non-Muslim companies and institutes, need to know the exact days of Muslim events beforehand in order to plan their leave of absence, inform their workplace and be able to celebrate these events with their families and friends without negatively affecting their affairs. This practical approach cannot be found easily in the second method, explained above.

    The seasons of blessings are only for a few days that soon end. Therefore, do not be negligent during this great month. Endeavour to do many acts of worship, obligatory and supererogatory (optional). Follow the etiquettes of fasting and the sunnah of our beloved Prophet Muhammad PBUH.

    May Allah SWT allow us to be of those who listen to the Words and follow the best thereof, those are whom Allah has guided and those who understand. May Allah SWT give us the strength to fast Ramadan’s days, pray its nights and complete the full recitation of the Holy Qur’an (khatm). Ameen.
